Negotiations about Brexit have resulted in a number of developments that are relevant for the European Trademark. Nothing has been finally agreed yet but the following proposals are likely to be accepted:
-There will be no EU Trademark changes before December 31st, 2020
-As from January 1st 2021 the EU Trademarks will no longer be valid in the United Kingdom.
-From that date the UK part of all European Trademark Registrations will be replaced by an identical UK trademark registration, without any action to be taken by the trademark owners.
-For EU trademarks that have been filed, but have not yet been registered, the owners will get the option to file an equal UK trademark registration until 30 September 2021 and claim the priority of the original EU trademark application.
