11. Do I have to register a trademark to obtain protection?

Yes. One can not claim trademark protection without a trademark registration in the European Community. Trademark registration gives an exclusive right to use the mark on or in connection with the goods or services designated in the registration. With a Community Trademark the registration or use of a conflicting later trademark by a third party can be prevented anywhere in the EU.
