Once an opposition against an application has been admitted and all formalities have been checked, the "Cooling Off" period starts. This is a 2 month period in which the opponent and the applicant or their representatives can contact eachother and have the possibility to come to an agreement or friendly settlement before the opposition actually starts. If an agreement is reached by both parties this ends the opposition and neither party will be ordered to pay the costs.
If an agreement is reached based on a restriction of the list of goods and services of the Community trade mark (by deleting those affected by the opposition) or a withdrawal of the CTM application, the Office will refund the opposition fees to the opponent. |
